A class action lawsuit captioned Kyle O’Leary v. Tom James Company, Case No. 23-CV-52261 (“Lawsuit”), was filed in the Chancery Court for Williamson County, Tennessee (“Court”), on behalf of all current and former Tom James Company employees whose personal information may have been impacted in a data breach that occurred on or about August 20, 2022 (“Class”). The Lawsuit alleges that the Tom James Company acted improperly in securing personal information.
The Tom James Company denies any wrongdoing and denies the claims and allegations asserted in the Lawsuit. The Court has not ruled on the merits of the plaintiffs’ claims and has made no determination of violations or liability against the Tom James Company. The parties nevertheless have agreed to settle the Lawsuit (“Settlement”) to avoid the risks and uncertainties of continued litigation.
You may receive three years of one-bureau credit monitoring services if you are a member of the Class and timely submit an approved claim form.

EXCLUDE YOURSELF BY JUNE 24, 2024 | You will not receive credit monitoring services under the Settlement, and you will not be bound by the terms of the Settlement. This is the only option that allows you to ever be part of any other lawsuit against the Tom James Company about the legal claims in this case. |

The Court in charge of this case must still decide whether to grant final approval of the settlement. Vouchers for credit monitoring services will be issued if the Court grants final approval and after appeals, if any, are resolved. Please be patient.
